1. Definition of terms

1.1. These business terms and conditions (hereinafter referred to as "T&C") more closely define and specify the rights and obligations of the Organizer and the person who registers to participate in the Event (hereinafter referred to as the "Participant") as parties to the so-called unnamed contract concluded pursuant to § 2079 et seq. Act No. 89/2012 Coll., the Civil Code or other contractual relationship.

1.2. The provisions of these OPs form an integral part of the agreement of the contracting parties on the provision of services in the form of driving on the race track (hereinafter referred to as "Exhibition driving"), the provision of commercial space for the presentation of the company or the presentation of branded vehicle clubs.

1.3. The provisions of these OPs also regulate the rights and obligations of the contracting parties arising in connection with the use of the AMD Area.

1.4. The terms and conditions are an integral part of the purchase contract. The purchase contract and terms and conditions are drawn up in the Czech language. The purchase contract can be concluded in the Czech language.

1.5. "Organizer" means the company Československý automobile klub pro Morava a Silessko, zs., with registered office at Hvězdová 308/13, 602 00 Brno, ID number 023 682 69, registered at the Regional Court in Brno under file. trade mark L 17921, operator of the website www.BrnoGP.cz and organizer of the Event, a legal entity providing the Participant with any of the services listed in point 1.2 on the basis of a contract.

1.6. "Event" means the Event organized by the Organizer, held at the AMD premises under the name Brno Grand Prix Revival, which can be participated in after the registration has been duly submitted and the specified fee has been paid.

1.7. "Participant" means a natural or legal person who enters into a contract through the registration form or this person's escort (hereinafter referred to as "Other persons". The Participant is obliged to familiarize Other persons with the Business Terms and Conditions of the Event and they are obliged to comply with these terms and conditions.

1.8 "Other persons" means a natural person who accompanies the Event Participant and owns the authorization to enter the AMD premises.

1.8. "Personnel" means authorized employees of the Organizer ensuring the operation of the Event.

1.9. "Contract" means the contract for the provision of the service referred to in point 1.2 concluded for an indefinite period between the contracting parties; OP is an integral part of it.

1.10. "Party" means the Organizer and the Participant.

1.11. The OP version valid on the day of payment of the purchase price is decisive.

1.12. These OPs are freely accessible on the Organizer's website at www.BrnoGP.cz, where the Participant can familiarize themselves with them.

1.13. These OPs or their individual provisions can be excluded or replaced only by express agreement of the contracting parties in writing.

1.14. The protection of personal data and the sending of business communications is governed by the rules of the Personal Data Protection Policy, which are freely accessible on the Organizer's website at www.BrnoGP.cz, where the Participant can familiarize themselves with them.

2. Terms

2.1. For compliance with the provisions of this contract and business conditions by persons participating in the Event together with the Participant, such as his employees, representatives, contractual partners or guests (hereinafter referred to as "Other persons"), the Participant who is obliged to introduce them to all other persons participating in the Event.

2.2. Motor sport is dangerous and the Participant acknowledges this.

2.3. The organizer is not responsible for securing the belongings of all persons participating in the Event against loss and damage.

2.4. Participants of the Event, except for visitors, are allowed to bring any food and drinks to the Event exclusively for their own personal use. The provision of food / restaurant / catering services in the Automotodrom Area is completely prohibited and the Participant as well as Other persons are obliged to refrain from such conduct. The provision of service and commercial services is possible only on the basis of the prior written permission of the Organizer. If the Participant or other persons violate this obligation, the Participant shall pay a contractual fine of CZK 150,000 per day to the Organizer for each such breach of contractual obligation, immediately after receiving the first request for payment from the Organizer.

2.5. It is absolutely necessary to follow traffic signs and traffic regulations on road traffic in the entire Automotodrom Area.

2.6. The movement of unauthorized persons and dogs or other animals in the start and finish area, pits and on the race track is strictly prohibited.

2.7. Persons under the age of 15 can only access the Automotodrom Area when accompanied by a person over the age of 18, and this person is fully responsible for their behavior. Children under the age of 15, persons on roller skates, skateboards or bicycles are strictly prohibited from entering the area in front of the pit lane and the start and finish line. The free movement of children under the age of 15 on motorcycles or minibikes is prohibited throughout the Automotodrom Area. Children under the age of 15 are strictly prohibited from entering the service road along the race track. Children under the age of 18 are strictly prohibited from entering the racing track and may not engage in sports activities.

2.8. Driving under the influence of intoxicating substances (alcohol, drugs) is strictly prohibited on the race track and in the entire Automotodrom Area.

2.9. Driving on the race track and service road outside the designated times is strictly prohibited. If the Participant or other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 50,000 for each such breach of contractual obligation, immediately after receiving the first request for payment from the Organizer.

2.10. The Organizer warns the Participant that if the Participant intends to use recorded music or other artistic production in the Automotodrom Area, he is obliged to conclude a prior agreement with the organization for the protection of the rights of performing artists Intergram and with the organization for the protection of copyright OSA or, where appropriate, with other relevant collective copyright administrators rights. If the Participant or Other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 20,000 for each such breach of contractual obligation, immediately after receiving the first request for payment from the Organizer.

2.11. The Participant is responsible for all damages incurred by the Organizer or AMD due to damage or destruction of its property by the Participant or a person participating in the Event together with the Participant.

2.12. In connection with the security regime of the Automotodrom area, the Participant is obliged to provide all other persons with appropriate entrances and exits. The participant is obliged to present these documents to the security staff upon arrival at the premises.

2.13. Not allowed before 7 am and after 9 pm the surroundings of the motor-motodrome area are burdened with impermissible noise from the operation of motor vehicles or other sources of noise. If the Participant or Other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 100,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.

2.14. Service communication is a particularly dangerous area and only persons approved by the Organizer have access to it. Traffic is one-way in the direction of travel along the race track. Exceptions are vehicles with right-of-way – ambulances, rescue system. All such persons will be wearing a reflective warning vest and will be instructed by the Organizer or Staff about the possible risks of moving on service roads and must sign such instruction and consent to this risk.

2.15. Max. speed in the area (except the race track) is 20 km/h.

2.16. Lunch break, safety break, liquidation of the consequences of the accident, delayed start of the Event are not considered to be an interruption of the use of the facilities of the Automotodrom Area affecting the pre-agreed price. He decides on the traffic on the race track Organizer.

2.17. Event participants and other persons have access to the automotodrome area on Thursday 7/11. 2024 from 4:00 p.m. to 8:00 p.m., on Friday 7/12. 2024 from 8.00 a.m. to 8.00 p.m., on Saturday 13.7. 2024 from 7.00 a.m. to 9.00 p.m. and on Sunday 14.7. 2024 from 7.00 a.m. All participants and other persons are obliged to leave the Automotodrom area no later than Sunday 14 July. 2024 until 22.00. Later departure is possible only on the basis of the prior written permission of the Organizer.

2.18. Event participants and other persons have the opportunity to spend the night at the automotodrom area in reserved places. It is not possible to leave or enter the Area during the times between the closing and opening of the Automotodrom Area mentioned in point 17.

2.19. The organizer will do administrative acceptance of the Participants of the Exhibition Rides. All persons who do not show up for the administrative check-in or do not pass it are prohibited from entering the race track.

2.20. The organizer will do technical acceptance of the vehicles of the participants in the Exhibition rides. All vehicles that do not come to the technical inspection or do not pass it are prohibited from entering the race track.

2.21. Organizers the right of control belongs to that persons moving along the race track have appropriate safety features and equipment. The safety of people on the racetrack is a priority in all cases of its use.

2.22. All Participants Exhibition rides are obliged to comply with the basic regulations of the FIA, FIM international sports regulations, especially the drivers must be trained and familiarized with safety flag signaling when operating on the race track. Participants Exhibition riders are required to attend a discussion with the riders prior to the start of the Exhibition rides.

2.23. The equipment used must be used only for the agreed purposes. In the pits and in the safety zone behind the pits (up to the white line) it is forbidden to spend the night, smoke and handle open flames - grilling and operating catering services. Compliance with this regulation will be checked during the Event. If the Participant or Other persons violate this regulation, the Participant shall pay the Organizer a contractual fine of CZK 50,000 for each detected case of violation, immediately after receiving the first request for payment from the Organizer. The Participant and Other persons are obliged to use electric hand tools that meet the ČSN EN 50699 standard and electrical appliances that meet the ČSN EN 50678 standard.

2.24. It is forbidden to use electric or gas heating equipment in the entire area of the Brno automotodrome, including the pits, without the prior written consent of the Organizer. If the Participant or other persons violate this obligation, the Participant shall pay a contractual fine of CZK 20,000 to the Organizer for each such case of breach of contractual obligation, immediately after receiving the first call for payment from the Organizer.

2.25. Any kind of drilling into the asphalt (building tents anchored to the ground, etc.) is strictly prohibited in all areas of the Automotodrom Area. For these tents, the Organizer has designated an area in the parking lot of the racing machines. If the Participant or other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 150,000 for each such breach of contractual obligation, immediately after receiving the first request for payment from the Organizer.

2.26. Participants and other persons are obliged to pay attention to the protection of the environment and are obliged to put garbage in containers and used oil in prepared containers in the pit area, to observe traffic signs in the area and a speed of 20 km/h. If the Participant or Other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 20,000 for each such breach of contractual obligation, immediately after receiving the first request for payment from the Organizer. Furthermore, Participants are obliged to use water sparingly. It is strictly forbidden to turn on taps for no reason, to cool drinks under running water and to fill swimming pools. If the Participant or Other persons violate this regulation, the Participant shall pay the Organizer a contractual fine of CZK 50,000 for each detected case of violation, immediately after receiving the first request for payment from the Organizer. Storage of used tires will be charged in the amount of CZK 100/1 tyre.

2.27. The free running of animals, especially dogs, is prohibited in the entire area of the Automotodrom Area, and if the Participant or other persons violate this obligation, the Participant shall pay a contractual fine of CZK 10,000 to the Organizer for each such breach of the contractual obligation, immediately after receiving the first notice to be paid by the Organizer. Every owner is required to keep their dog on a leash and put a muzzle on it.

2.28. It is forbidden to use unmanned aerial vehicles (UAVs – drones) in the entire area of the Brno automotodrome, including the pits, without the prior written consent of the Organizer. If the Participant or Other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 100,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.

It's on the race track it is forbidden to use electric vehicles without the prior written consent of the Organizer. Charging of electric vehicles is prohibited in the entire area of the Brno automotodrom, including the pits, without the prior written consent of the Organizer. If the Participant or Other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 100,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.

2.29. In case of violation of these terms and conditions, if these terms and conditions do not provide for a different penalty, or damage to equipment in the Automotodrom Area, the Organizer is entitled to claim a contractual fine of CZK 50,000 from the Participant for each such breach of contractual obligation, immediately after receiving the first notice to be paid by the Organizer.

2.30. The Participant's price includes first medical aid in case of injury to the Participant or other persons. This medical treatment is carried out at the scene of the accident and, if necessary, at the medical center at the Brno Automotodrom Complex. Medical examination and treatment will be provided free of charge to the extent that does not include points 2.31. and 2.32. or more complex than the procedures and treatments listed there.

2.31. Treatment of more serious injuries, in which it is necessary to use an X-ray examination and definitive treatment by applying a plaster cast or surgical treatment with a suture (sewing), will be paid for by the injured person in cash or by payment card on the basis of a document issued according to the list of medical procedures, which is valid in all medical facilities in the territory of the Czech Republic. The value of 1 point is contractually set at CZK 15 in the Participant's non-state healthcare facility.

2.32. The use of special (extra-standard) dressing material or orthopedic aids, to which the injured person gives his consent, will be charged according to the valid List of medical equipment or according to the calculated price and paid to the injured person in cash or by payment card based on the issued document.

2.33. Medical transportation (transportation) of the injured rider by ambulance in the Automotodrom area is included in the price. The transport of the injured (by ambulance or helicopter) to the hospital in Brno, as indicated by the attending physician, will be arranged by the attending physician. Reimbursement for this transportation service is paid to the insured carrier.

2.34. If necessary, the Participant will be provided with an accompanying person with a vehicle during the transport to the hospital, who will provide personal documents, means of payment and clothes of the injured person, or handle other requirements. If the injured person has adequate insurance, the costs will be reimbursed to him as follows, based on the issued documents, by his contracted insurance company. The participant of Exhibition rides is obliged to have identification data, driver's license and information about the health insurance company available before the start of the motoring event. If it is necessary to provide medical assistance, the Participant or the Organizer is obliged to make this data regarding the concerned Participant immediately available to the provider.

2.35. Traffic on the race track is exempted from legal regulations - Act on Traffic on Land Roads 361/2000 Coll. and Decree No. 30/2001 Coll. The insurance "Liability for damage caused by the operation of a motor vehicle (compulsory liability)" does not apply to operation on the race track.

2.36. The organizer has a third-party liability insurance contract covering the Participant's and all other persons' liability for the entire duration of the Event. In the event of an accident, the organizer will ensure the processing of the accident record. The Organizer recommends that Individual Participants of Exhibition Rides take out their own accident and accident insurance for the sports activity.

2.37. The organizer is authorized to make photographic and audiovisual records of the event. The Organizer is entitled to transfer these records to another person.

The Participant and Other Persons are obliged to respect the existing advertisements of third parties in the Automotodrom Area and the performance associated with them, and these advertisements must not overlap or make it difficult to see them in any way, and if the Participant or Other Persons violate this obligation, they will be asked by the Organizer to immediately remove this fact. In the event that the Participant or Other persons do not obey the immediate call, the Participant shall pay the Organizer a contractual fine of CZK 500,000 for each such breach of contractual obligation, immediately after receiving the first call for payment from the Organizer.

2.38. Activities in the motor racing area, such as installing VIP tents, banners, advertising flags, etc., are prohibited without prior written agreement with the Organizer, and if the Participant or other persons violate this obligation, the Participant shall pay the Organizer a contractual fine of CZK 250,000 per any such case of breach of contractual obligation, immediately after receiving the first call for payment from the Organizer.

2.39. The Participant and Other Persons undertake to comply with all extraordinary measures and recommendations of the Government of the Czech Republic, the Ministry of Health of the Czech Republic, the regional hygiene station or other state administration bodies related in particular to the spread of the COVID-19 infection.

2.40. Consent to the GDPR and the Visiting Regulations of the AMD campus are part of these terms and conditions. In the event of a conflict between the provisions of the Business Terms and Conditions for participants and the Visiting Regulations of the AMD campus, the provisions of the Business Terms and Conditions for participants shall apply. A Special Provision is also part of the business terms and conditions for the Participants of the Exhibition Rides.

2.41. By sending the order form, the Participant agrees to the terms and conditions stated in point 40. All terms and conditions are published on the website www.BrnoGP.cz.

2.42. The Participant agrees to send information related to the Event and services or E-tickets of the Organizer to the Participant's electronic address and also agrees to send the Organizer's business communications to the Participant's electronic address.

2.43 The participant agrees to the storage of so-called cookies on his computer. In the event that it is possible to register on the website and fulfill the Organizer's obligations from the purchase contract without so-called cookies being stored on the Participant's computer, the Participant may revoke the consent according to the previous sentence at any time.
