These terms and conditions and the complaint procedure (hereinafter referred to as "OP") apply when purchasing e-tickets from the company Československý automobile klub pro Morava a Silessko, zs., Hvězdová 308/13, 602 00 Brno, IČ 023 682 69, registered at the Regional Court in Brno under file. stamp L 17921 (hereinafter referred to as "ČAMS") for the provision of an E-ticket delivery service for the Brno Grand Prix Revival event held at the Automotodrom Brno complex, Masarykův okruh 201, 664 81 Ostrovačice (hereinafter referred to as "AMD").

ČAMS business terms and conditions

1. Introductory provisions and definitions of terms

1.1. These terms and conditions (hereinafter referred to as "OP") define and specify the rights and obligations of ČAMS and the person who purchases an E-ticket, a Ticket, or who purchases an E-ticket sold by ČAMS (hereinafter referred to as the "Customer") as contractual parties from so-called unnamed contracts concluded according to § 2079 et seq. Act No. 89/2012 Coll., the Civil Code or other contractual relationship.
1.2. These OPs apply exclusively to the relationship between ČAMS and the Customer, not to the relationship between ČAMS and entrepreneurs.
1.3. The provisions of these OPs form an integral part of the contract between the contracting parties on the provision of the E-ticket delivery service through the online store operated by ČAMS.
1.4. The provisions of these OPs also regulate the rights and obligations of the contracting parties arising in connection with the use of the online store by the Customer.
1.5. The terms and conditions are an integral part of the purchase contract. The purchase contract and terms and conditions are drawn up in the Czech language. The purchase contract can be concluded in the Czech language.
1.6. "ČAMS" means the Czechoslovak Automobile Club for Moravia and Silesia, zs., with registered office at Hvězdová 308/13, 602 00 Brno, ID number 023 682 69, registered at the Regional Court in Brno under file. No. L 17921, operator of an online store, a legal entity providing the Customer with the service of delivering an E-ticket via an online store based on a contract.
1.7. "Event" means the Event organized by ČAMS, held at the AMD premises under the name Brno Grand Prix Revival, which can be attended upon presentation of a properly printed E-ticket, and for which an E-ticket can be purchased via the online store or a Ticket in day of the Event at the box office in the AMD premises.
1.8. "Customer" means a natural person who, when concluding a contract and using the online store, is not acting in the context of his business or other business activity or in the independent performance of his profession and has the status of customer of the service of delivery of an E-ticket via the online store or Tickets purchased at the box office in AMD campus.
1.9. "Entrepreneur" means a natural or legal person who, when concluding a contract and using the online store, acts as part of his business or other business activity or as part of the independent exercise of his profession.
1.10. "Internet shop" means the web portal www.BrnoGP.cz operated by ČAMS and enabling the conclusion of a contract.
1.11. "Ticket" means the ticket that the Customer receives after payment has been made for visitors on the day of the Event at the box office in the AMD premises.
1.12. "E-Ticket" means a Ticket with a unique number and barcode or QR code, which is printed by the Customer on A4 paper, or a Ticket in PDF format with a unique number and barcode or QR code, which is presented by the Customer via a portable electronic device in such a way that so that the code can be properly read by a mobile reader (especially a mobile phone or tablet), and which entitles one holder of this document to enter the Event at a certain place and during a certain time period.
1.13. "Wristband" means the identification band that the Customer receives after presenting a valid Ticket or E-Ticket at the ticket office before entering the AMD premises.
1.14. "Tribune Ticket" entitles the Customer to enter grandstands C, F, T3 and T5.
1.15. The "Depot Ticket" entitles the Customer to enter grandstands C, F, T3 and T5 and the racing machine depot, pitwalk during the lunch break.
1.16. The "VIP ticket" entitles the Customer to enter stands C, F, T3 and T5 and the racing machine depot, pitwalk during the lunch break, parking in the VIP parking lot behind stands T3 and T5 in the AMD area, access to the air-conditioned lounge with a view of the finish line , catering in the form of cold and hot cuisine as part of the morning and afternoon buffet, lunch, hot and cold drinks, driving along the service road just along the track by means of a shuttle bus (only for people over 15 years old).
1.17. "Ticket Driving along the service road" entitles the Customer to drive on the service road right next to the runway by means of a shuttle bus. The ticket can only be used by a person older than 15 years.
1.18. "Children's Ticket" means a special discounted ticket for children from 7 to 12 years inclusive.
1.19. "Family admission" means a special discounted admission for families, exclusively intended for one to two adults and one to two children under the age of 12 inclusive.
1.20. "Personnel" means authorized employees of ČAMS ensuring the operation of the Event, in particular cashiers, ticket inspectors, parking attendants and security.
1.21. "Agreement" means a contract for the provision of an E-Ticket delivery service via the online store or Tickets purchased at the ticket office in the AMD premises concluded for an indefinite period between the contracting parties; OP is an integral part of it.
1.22. "Contract party" means ČAMS and the Customer.
1.23. By purchasing a Ticket or E-Ticket, the Customer agrees to these terms and conditions and all of its appendices, which are binding on both parties. The OP version valid on the day of payment of the purchase price of the ticket is decisive.
1.24. These OPs are freely accessible on the ČAMS website at www.BrnoGP.cz, where the Customer can familiarize themselves with them.
1.25. These OPs or their individual provisions can be excluded or replaced only by express agreement of the contracting parties in writing.
1.26. The protection of personal data and the sending of business communications is governed by the rules of the Personal Data Protection Policy, which are freely accessible on the ČAMS website at www.BrnoGP.cz, where the Customer can familiarize themselves with them.

2. User account

2.1. Based on the Customer's registration on the website www.BrnoGP.cz, the Customer can access its user interface. From its user interface, the Customer can order E-tickets (hereinafter referred to as "user account"). If the store's web interface allows it, the Customer can also order E-tickets without registration directly from the store's web interface.
2.2. When registering on the website www.BrnoGP.cz and when ordering E-tickets, the Customer is obliged to enter all data correctly and truthfully. The Customer is obliged to update the data specified in the user account in case of any change. The data provided by the Customer in the user account and when ordering E-tickets are considered correct by ČAMS.
2.3. Access to the user account is secured by a username and password. The customer is obliged to maintain confidentiality regarding the information necessary to access his user account.
2.4. The customer is not authorized to allow the use of the user account by third parties.
2.5. ČAMS can cancel the user account, especially if the Customer does not use his user account for more than 12 months, or if the Customer violates his obligations under the purchase contract (including terms and conditions).
2.6. The customer acknowledges that the user account may not be available continuously, especially with regard to the necessary maintenance of ČAMS hardware and software equipment, or necessary maintenance of hardware and software equipment of third parties.

3. Conclusion of the purchase contract

3.1. All presentations of E-tickets placed in the web interface of the store are of an informative nature and ČAMS is not obliged to enter into a purchase contract regarding these E-tickets. The provisions of Section 1732, paragraph 2 of the Civil Code shall not apply.
3.2. The store's web interface contains information about E-tickets, including the prices of individual E-tickets. E-ticket prices are listed including value added tax and all related fees. E-ticket prices remain valid for as long as they are displayed in the store's web interface. This provision does not limit the possibility of ČAMS to conclude a purchase contract under individually agreed conditions.
3.3. To order E-tickets, the Customer fills out the order form in the store's web interface. The order form contains, in particular, information about the ordered E-tickets (the Customer "puts" the ordered E-tickets into the electronic shopping basket of the store's web interface) and the method of payment of the purchase price of the E-tickets (together referred to as the "order").
3.4. Before sending the order, the Customer is allowed to check and change the data entered by the Customer in the order, also taking into account the Customer's ability to detect and correct errors that occurred when entering data into the order. The order is sent by the Customer by clicking the "Order" button. The information given in the order is considered correct by ČAMS.
3.5. The contractual relationship between ČAMS and the Customer is established by delivery of the order acceptance (acceptance), which ČAMS sends to the Customer by e-mail, to the Customer's e-mail address.
3.6. The customer agrees to the use of remote communication means when concluding the purchase contract. The costs incurred by the Customer when using means of communication at a distance in connection with the conclusion of the purchase contract (costs of Internet connection, costs of telephone calls) are paid by the Customer himself, and these costs do not differ from the basic rate.

4. E-ticket sale

4.1. These terms and conditions apply to the purchase of E-tickets for the Event, namely when purchased via the website operated by ČAMS.
4.2. The customer can purchase E-tickets for a specific Event via the Internet and pay:
a) by online payment provided by the Comgate payment gateway. The service provider, Comgate as, is a licensed Payment Institution operating under the supervision of the Czech National Bank. Payments made through the payment gateway are fully secured and all information is encrypted. More information and contacts at www.comgate.cz.
b) by bank transfer to the ČAMS bank account No. 2800530818/2010, maintained at the company Fio banka, as.
In order to make a purchase, you must enter a valid email address and valid contact information (name, surname, or zip code) in the online application.
4.3. The customer is obliged to pay the purchase price of E-tickets together with the indication of the variable payment symbol (order number). The Customer's obligation to pay the purchase price is fulfilled when the relevant amount is credited to the ČAMS account.
4.4. The customer acquires ownership of the E-tickets by paying the full purchase price of the goods.
4.5. After crediting the relevant amount to the ČAMS account based on the purchase contract, ČAMS will issue a tax document - an invoice - to the Customer. ČAMS is not a value added tax payer. Tax document – CMAS will send the invoice to the Customer at the same time as the order to the Customer's email address.
4.6. If the Customer purchases a discounted E-ticket for a child under 12 years of age and a family ticket, he is required to present a document authorizing the use of this discounted ticket upon entry. If the claim is not proven, the ticket is invalid.
4.7. If the Customer purchases a Ticket for a ride on service roads, he is required to present a document proving that the Customer is over 15 years old before the ride. If the claim is not proven, the ticket is invalid.
4.8. After the full price of the E-ticket or E-tickets has been paid by the Customer and this amount has been credited to the ČAMS bank account, ČAMS will send the purchased E-tickets to the email address specified by the Customer within 5 working days.
4.9. In the event that the Customer enters an incorrect email, ČAMS is not responsible for the delivery of the E-ticket. Non-delivery of the E-ticket in such a case is not a reason for a complaint and no compensation is provided for them.
4.10. ČAMS is not responsible for the fact that the E-ticket is considered as junk mail.
4.11. Numeric barcodes or QR codes on E-tickets can only be removed by the reading device once, i.e. any further presentation of a numeric barcode or QR code in the form of a printout or display on a mobile device will not be taken into account and based on them, the E-ticket will not be taken into account allowed to enter the AMD premises, regardless of who presents the above-mentioned tickets.
4.12. ČAMS is not responsible for any difficulties caused by unauthorized use or copying of the E-ticket. Forging it is a crime. The e-ticket also becomes invalid if it does not contain the data required for its control or if it has been modified by additional modifications.
4.13. The validity of the E-ticket is governed by the opening hours for visitors to the Event. Current opening hours and validity are indicated on the Ticket or on the Event website www.BrnoGP.cz.
4.14. The validity of the E-ticket also expires if it remains unused after the end of the Event or its validity. The entrance fee is non-refundable for a ticket that is not used in whole or in part.

5. Sale of Tickets at the box office in the AMD area

5.1. ČAMS allows the Customer to purchase the Ticket in cash or by payment card, if the ticket office is equipped with a payment terminal.
5.2. The purchase price of the Ticket is determined by the current ČAMS price list, which is published on its website and at the cash desks in the AMD area.
5.3. When paying for a Ticket, the customer is obliged to verify the correctness of the returned funds, the chosen specific Event and the type of Ticket immediately after receiving them. ČAMS is not obliged to recognize later applied defects consisting of incorrectly returned cash or incorrect information on the Ticket.
5.4. A child under the age of 6 (inclusive) is admitted free when accompanied by a person older than 18. The child does not need a separate ticket, the entitlement to free entry will be verified by the Staff at the entrance on the basis of the presented document with the child's date of birth (ZP card, birth certificate, passport, pre-paid fare coupon, etc.)
5.5. Under the conditions stated in this provision, a person with a valid ZTP/P card is entitled to one free Ticket of the same type for one additional person as their guide in addition to the purchased Depo Ticket or Grandstand Ticket for the Event. A guide can only be a person of legal age who is objectively fully capable of providing the accompanied person with the necessary assistance for the entire duration of their stay at the Event.

6. Terms of registration and use of promo codes

6.1. Registration for visitors, confirmation of registration and Ticket for visitors does not replace an exhibitor card, accreditation card for journalists, assembly and disassembly card and does not entitle you to enter the premises at a time other than the operating hours designated for visitors.
6.2. Visitors are subject to the Visitor Regulations when entering the AMD premises. The registration confirmation (or Ticket without price) that the registered visitor receives is valid for one person and one use.
6.3. Abuse of the registration system, subsequent resale or distribution of tickets to other persons is strictly prohibited. The occurrence of registrations and the use of Tickets at the entrances is monitored and can serve as a basis for the Police of the Czech Republic and subsequent recovery of damages.
6.4. By providing data during registration, the visitor grants ČAMS consent pursuant to Act No. 101/2000 Coll. on the protection of personal data, so that his personal data can be processed for the purpose of offering business and services, especially for marketing purposes (e.g. analysis, organizing other Events, sending e-newsletters, etc.), for the needs of ČAMS. ČAMS is also entitled to transfer such personal data to another entity for processing, but only for the purposes of offering business and services. The website visitor provides consent voluntarily and can revoke it at any time.
6.5. In the case of registrations where a code from a company invitation was used (bulk code, promo code, etc.), the data provided may be transferred to a third party - the owner of the code used.

7. Other conditions

7.1. The Customer is always obliged to present the Ticket or E-ticket for inspection in order to allow the Customer to enter, namely to ČAMS Personnel.
7.2. After presenting a valid E-ticket or purchasing a Ticket at the box office in the AMD premises, the Customer will be issued a Wristband, in the case of a Family Ticket, a Wristband for all persons meeting the conditions of the Family Ticket (except for children under 5 years of age included).
7.3. The customer is obliged to properly place the Wristband on his wrist. No other location is allowed. If the Armband is placed incorrectly or if it is damaged, entry to the AMD campus will not be permitted.
7.4. The customer is obliged to have the Hand Strap properly placed on the wrist during the entire stay in the AMD premises. In the event of its loss or damage, the Customer may be asked by the Staff to leave the premises of the Event without the right to compensation.
7.5. By purchasing a Ticket or E-Ticket, the Customer agrees to comply with the Visitor Rules for the entire duration of their stay at the Event. The customer has the opportunity to familiarize himself with the Visitor Regulations at the Internet address: www.BrnoGP.cz.
7.6. ČAMS reserves the right to change the program, accompanying program or change exhibitors or exhibits. ČAMS is not responsible for any damage caused to the Customer or a third party in connection with the above changes.
7.7. The customer hereby assumes the risk of a change in circumstances within the meaning of § 1765, paragraph 2 of the Civil Code.

8. Protection of personal data

8.1. The protection of personal data of the Customer, who is a natural person, is provided by Act No. 101/2000 Coll., on the protection of personal data, as amended.
8.2. The customer agrees to the processing of his personal data: first and last name, residential address, identification number, tax identification number, e-mail address, telephone number (hereafter collectively referred to as "personal data").
8.3. The customer agrees to the processing of personal data by ČAMS, for the purposes of realizing rights and obligations from the purchase contract and for the purposes of maintaining a user account. If the Customer does not choose another option, he agrees to the processing of personal data by ČAMS also for the purpose of sending information and business communications to the Customer. Consent to the processing of personal data in its entirety according to this article is not a condition that would in itself make it impossible to conclude a purchase contract.
8.4. The customer acknowledges that he is obliged to provide his personal data correctly and truthfully (when registering, in his user account, when ordering from the web interface) and that he is obliged to inform ČAMS without undue delay about a change in his personal data.
8.5. ČAMS can entrust a third party as a processor with the processing of the Customer's personal data.
8.6. Personal data will be processed indefinitely. Personal data will be processed in electronic form in an automated manner or in printed form in a non-automated manner.
8.7. The customer confirms that the personal data provided is accurate and that he has been informed that this is a voluntary provision of personal data.
8.8. In the event that the Customer believes that ČAMS or the processor (Art. 8.5.) is processing his personal data in violation of the protection of the Customer's private and personal life or in violation of the law, especially if the personal data is inaccurate with with regard to the purpose of their processing, may ask ČAMS or the processor for an explanation or demand that ČAMS or the processor remove the state thus created.
8.9. If the Customer requests information about the processing of his personal data, ČAMS is obliged to provide him with this information. ČAMS has the right to request a reasonable payment not exceeding the costs necessary to provide the information for the provision of information according to the previous sentence.

9. Sending commercial messages and storing cookies

9.1. The Customer agrees to send information related to the Event, services or E-tickets to ČAMS to the Customer's email address and further agrees to send ČAMS business communications to the Customer's email address.
9.2. The customer agrees to the storage of so-called cookies on his computer. In the event that it is possible to make a purchase on the website and to fulfill the obligations of ČAMS from the purchase contract without so-called cookies being stored on the Customer's computer, the Customer may revoke the consent at any time in accordance with the previous sentence.

10. Final Provisions

10.1. If the relationship established by the purchase contract contains an international (foreign) element, then the parties agree that the relationship is governed by Czech law. This does not affect consumer rights arising from generally binding legal regulations.
10.2. If any provision of the terms and conditions is invalid or ineffective, or becomes so, the invalid provision will be replaced by a provision whose meaning is as close as possible to the invalid provision. The invalidity or ineffectiveness of one provision does not affect the validity of the other provisions.
10.3. The purchase contract, including the terms and conditions, is archived by ČAMS in electronic form and is not accessible.

Complaints Procedure

1. Making a complaint

1.1 The paid Ticket, E-ticket or identification bracelet cannot be exchanged. In the event of damage, destruction, loss or theft of the Ticket, E-ticket or identification bracelet, it will not be replaced with a new one and the Customer will not be reimbursed.
1.2 The Customer is obliged to make a claim for the purchased E-ticket within 48 hours of receiving the E-ticket via a written notification to ČAMS, and to make a claim for the Ticket purchased on the spot on the day and time of purchase directly at the box office.
1.3 ČAMS is responsible to the Customer for the proper and timely provision of the E-ticket according to the contract. ČAMS is not responsible to the Customer for the proper and timely provision of the E-ticket in accordance with the contract, especially if the E-ticket was not properly and timely provided to ČAMS as a result of the Customer's actions or omissions.
1.4 ČAMS is responsible to the Customer for ensuring that all E-tickets delivered to the Customer are in accordance with the contract upon their delivery. ČAMS is not responsible to the Customer for the fact that all E-tickets delivered to the Customer are in accordance with the contract when they are delivered, especially if any discrepancy with the contract was caused by the Customer or if the Customer knew about this discrepancy before receiving the E-ticket.
1.5 The rights and obligations of the Contracting Parties arising as a result of improper or untimely provision of the E-ticket according to the contract are adequately governed, in particular, by the provisions of Part Four, Title I, Part 7, Section 1 of Act No. 89/2012 Coll., Civil Code, in wording of later regulations.
1.6 If ČAMS does not provide the E-ticket in accordance with the contract on time, the Customer is obliged to deliver a written notification to ČAMS immediately, no later than within 48 hours from the date of ČAMS's delay. ČAMS is obliged to provide the E-ticket according to the contract within an additional period of 5 working days from the date of delivery of the Customer's written notification in accordance with this provision, unless a longer period is specified by the Customer. If ČAMS does not provide the E-ticket in accordance with the contract even within this additional period, the Customer is obliged to deliver a written notification of this to ČAMS immediately, at the latest within 48 hours from the date of the delay of ČAMS in providing the E-ticket in accordance with the contract in the additional period . At the same time, the Customer is given the right to withdraw from the contract. The Customer can exercise this right within 48 hours from the date of ČAMS's delay in providing the E-ticket according to the contract within an additional period, after which this right expires.
1.7 If ČAMS does not provide the E-ticket properly according to the contract, the consumer is obliged to notify ČAMS in writing immediately, no later than 48 hours from the date of non-proper performance by ČAMS. ČAMS is obliged to properly provide the E-ticket according to the contract within an additional period of 5 working days from the date of delivery of the Customer's written notification in accordance with this provision, unless a longer period is specified by the Customer. If ČAMS does not properly provide the E-ticket in accordance with the contract even within this additional period, the consumer is obliged to deliver a written notification of this to ČAMS without delay, no later than 48 hours from the date of ČAMS's delay in properly providing the E-ticket in accordance with the contract within the additional period . At the same time, the Customer is given the right to withdraw from the contract. The Customer can exercise this right within 48 hours from the date of delay of ČAMS with the proper provision of the E-ticket according to the contract within an additional period, after which this right expires.
1.8 The consumer is entitled and obliged to exercise all rights according to the provisions of Article 5 of the OP to the e-mail address of ČAMS: info@brnogp.cz.
1.9 If during the Event there is such a change in conditions, especially weather conditions and those caused by force majeure, which ČAMS could not prevent, and which will not allow the safe execution of the Event, ČAMS is not obliged to return the payment.
1.10 The customer is not entitled to exercise rights arising from defective performance of Tickets or E-tickets that he received free of charge from ČAMS or a company authorized by ČAMS (for example, as part of a promotional Event).

2. Termination of rights and obligations from the contract

2.1 The consumer is entitled and obliged to exercise the Customer's right to withdraw from the contract according to this provision of the OP only in writing to the ČAMS e-mail address: info@brnogp.cz by sending the Form for withdrawing from the contract, which is contained in Annex No. 1 of these OPs. The Customer is entitled and obliged to send a withdrawal from the contract to the ČAMS e-mail address specified in this provision within the deadline set for withdrawal, otherwise the withdrawal is ineffective.
2.2 ČAMS is given the right to withdraw from the contract without any penalty within a period of up to fourteen days if the Customer does not pay the price of all E-tickets according to the contract even within a period of 10 days from the date of conclusion of the contract. In this case, the Agreement is immediately canceled from the beginning.
2.3 By withdrawing from the contract, the contract is canceled from the beginning. The contracting parties are obliged to return to each other everything that they performed under the contract. After withdrawal from the contract, the E-ticket is not returned. After withdrawing from the contract, the customer is not entitled to dispose of the E-ticket or its printout in any way. After withdrawal, ČAMS is obliged to return the price paid by the Customer for the E-ticket according to the contract without delay, and at the latest within fourteen days from the date of withdrawal from the contract, unless otherwise stipulated, exclusively using the same payment method as the payment for the Ticket or E - a ticket.
