Terms and conditions for exhibitors at the Brno Grand Prix Revival 2024 event

of the Czechoslovak Automobile Club for Moravia and Silesia, zs. (hereinafter the Organizer), identification number: 02368269, with registered office at Hvězdová Street 308/13, 602 00 Brno, phone: +420 545 242 605, registered in the commercial register maintained by the Regional Court in Brno under file mark L 17921/KSBR for participation in the Brno Grand Prix Revival Event held on 11 - 14 July 2024 at the Automotodrom Brno complex, Masarykův okruh 201, 664 81 Ostrovačice (hereinafter referred to as "AMD").

The OP includes the following documents:

1. Definition of terms

 1.1. These business terms and conditions (hereinafter referred to as "OP") define and specify the rights and obligations of the Organizer and the natural or legal person who registers to participate in the Event (hereinafter referred to as the "Exhibitor") as parties to the so-called unnamed contract concluded pursuant to § 2079 and so on Act No. 89/2012 Coll., the Civil Code or other contractual relationship.
1.2. The provisions of these OPs and the Visiting Regulations form an integral part of the agreement of the contracting parties on the provision of services in the form of the provision of Commercial space for the presentation of the Company, presentation of the Company through the Logo in printed materials and on the podium, advertising of the Company in the Events program, placement of the Company Banner in the AMD premises and on the race track, provision of VIP tickets for Corporate Partners, provision of tickets for the Exhibitor's staff, parking in the area in the VIP parking lot.
1.3. The provisions of these OPs and the Visitor Regulations also regulate the rights and obligations of the contracting parties arising in connection with the use of the AMD Area.
1.4. The provisions of the OP and the Visiting Regulations are an integral part of the purchase contract. The purchase contract, the OP and the Visitor's Rules are drawn up in the Czech language. The purchase contract can be concluded in the Czech language.
1.5. In the event of a conflict between the terms of these OPs and the Visiting Regulations, the terms of the OP shall apply.
1.6. "Event" means the Event organized by the Organizer, held at the AMD premises under the name Brno Grand Prix Revival, which can be participated in after the registration has been duly submitted and the specified fee has been paid.
1.7. "Banner on the race track" means the banner delivered by the Exhibitor no later than 10/07/2024. The banner may not exceed 2 m2 in size. The banner will be placed on the race track in a visible place for visitors. The Organizer decides on the placement of the Banner.
1.8. "Banner in the AMD premises" means the banner delivered by the Exhibitor no later than 12.07.2024 by 12 noon. The banner may not exceed the size of 2 m2. The banner will be placed in the AMD premises in a visible place for visitors. The Organizer decides on the placement of the Banner.
1.9. "Company advertisement in the Event program" means an advertisement delivered by the Exhibitor in the format ordered when registering for participation.
1.10. "Commercial space" means an exhibitor's place on the outdoor area of the AMD premises, which will be accessible to all visitors to the Event.
1.11. "Logo on the podium" means the publication of the company's logo on the board behind the podium, where prizes will be awarded to competitors.
1.12. "Print logo" means the publication of the company's logo on the Event poster, which will be used to present the Event in print and online media and on the Organizer's website in the list of partners. The Exhibitor is obliged to provide the Organizer with a logo in the required format and agrees to its use. The logo will be placed in printed materials that will be produced after the date of the properly paid invoice for services issued by the Organizer or Representative.
1.13. "Other persons" means a natural person who accompanies the Company to the Event and is authorized to enter the AMD premises.
1.14. "Parking place near the Exhibitor area" means a specific place for parking in the AMD area, which will be determined by the Organizer. The Exhibitor or Other persons are obliged to park their vehicle in this reserved place. It is forbidden to park the vehicle anywhere else.
1.15. "Parking on the premises in the VIP parking lot" means the authorization to enter and park in the reserved parking lot in the AMD premises for the duration of the Event. This authorization is not transferable to multiple vehicles.
1.16. "Personnel" means authorized employees of the Organizer ensuring the operation of the Event.
1.17. "Organizer" means the company Československý automobile klub pro Morava a Silessko, zs., with registered office at Hvězdová 308/13, 602 00 Brno, ID number 023 682 69, registered at the Regional Court in Brno under file. trade mark L 17921, operator of the website www.BrnoGP.cz and organizer of the Event, a legal entity providing the Company with the service specified in point 1.2 on the basis of the contract.
1.18. "Contract" means the contract for the provision of the service referred to in point 1.2 concluded for an indefinite period between the contracting parties; OP is an integral part of it.
1.19. "Party" means the Organizer and the Exhibitor.
1.20. "VIP ticket" means a ticket entitling the Exhibitor or Other persons to enter grandstands C, F, T3 and T5 and to the racing machine depot, the pitwalk during the lunch break, parking in the VIP parking lot behind grandstands T3 and T5 in the AMD area, access to the air-conditioned a lounge with a view of the finish line, for people over 4 years of age, catering in the form of cold and hot cuisine as part of the morning and afternoon buffet, lunch, hot and cold drinks, for people over 15 years of age, a ride along the service road just along the track via a shuttle bus. The VIP ticket must be ordered in the e-shop on the Organizer's website. The VIP ticket is valid on Saturday or Sunday. The VIP ticket is non-transferable and will be exchanged for a wristband before entering the AMD premises for the first time.
1.21. "Ticket for the Exhibitor's personnel" means the authorization to enter employees, part-time workers and other persons authorized by the Exhibitor to install, operate and dismantle the Exhibitor's Place. The ticket for the Exhibitor's staff is non-transferable and will be exchanged for a wristband before entering the AMD premises for the first time.
1.22. "Exhibitor" means a natural or legal person who concludes a contract through the registration form or an accompanying person (hereinafter referred to as "Other Persons"). The exhibitor is obliged to register
1.23. "Representative" means the company Atelier Kupka s.r.o., with registered office at Hvězdová 308/13, 602 00 Brno, IČ 262 329 36, registered at the Regional Court in Brno under file. stamp C 38619, authorized by the Organizer to represent in matters of services according to point 1.2, including issuing invoices to Exhibitors for ordered services.
1.24. The OP version valid on the day of payment of the purchase price is decisive.
1.25. These OPs are accessible in the registration form on the Organizer's website at www.BrnoGP.cz, where the Exhibitor can familiarize themselves with them and will be sent by email together with the invoice for the ordered services.
1.26. These OPs or their individual provisions can be excluded or replaced only by express agreement of the contracting parties in writing.
1.27. The protection of personal data and the sending of business communications is governed by the rules of the Personal Data Protection Policy, which are freely accessible on the Organizer's website at www.BrnoGP.cz, where the Exhibitor can familiarize himself with them. 2. Applications and allocation of areas 2.1. It is possible to register for the Event exclusively on the basis of filling out a binding application form and accepting these OPs. The organizer decides on the acceptance of the application, shortening or expanding the ordered area, dimensions and type of exhibition area. The organizer is not obliged to comply with the exhibitor's request for the location of his exhibit.
2.2. Upon receipt of a properly completed application for participation in the Brno Grand Prix Revival, the Organizer or Representative will send the Exhibitor an advance invoice, which also confirms receipt of the application and confirmation of the extent of the allocated exhibition area. The exhibition area will be made available to the Exhibitor for the assembly of the exposition on Friday, July 12, 2024.
2.3. The condition for handing over the exhibition area to the Exhibitor is the payment of the advance invoice issued before 31/03/2024 by the specified date, but no later than 31/03/2024. by the specified date, but no later than 6/16/2024. 3. Price for providing exhibition space (hereinafter referred to as "price") 3.1. The price is always indicated in the application to participate in the Event. The area is allocated in modules with a basic size of 5 × 5 m.
3.2. The Exhibitor may not give the allocated exhibition space to a third party in any way.
3.3. If the Exhibitor, after receiving the advance invoice, notifies the Organizer in writing that he will not participate in the fair, this is a breach of contract on the part of the Exhibitor. For this violation, the Exhibitor is obliged to pay the Organizer a contractual penalty in the amount of 100 % of the total price. The organizer is entitled to withdraw from the contract after receiving a written notification from the Exhibitor about his non-participation in the Event. By paying the contractual penalty, the obligations of the contracting parties from this contract cease.
3.4. The exhibitor may not occupy a larger exhibition area than the one officially allocated to him. If the exhibitor is interested in expanding the area and the situation allows it, he must consult the Organizer about this fact. If the Organizer agrees, the Exhibitor undertakes to pay for the additionally occupied area by the due date indicated on the advance invoice issued by the Organizer or the Representative. 4. Price and payment conditions 4.1. The organizer will send the Exhibitor an advance invoice for the total price incl. VAT. Tax documents will be issued in accordance with applicable legal regulations.
4.2. In the event of non-payment of the advance invoice by the deadline stated on it, the Organizer is entitled to withdraw from the contract and the Exhibitor undertakes in this case to pay the Organizer a contractual penalty in the amount corresponding to the invoiced amount. By paying the contractual penalty, the obligations of the contracting parties from this contract cease.
4.3. All prices for performance provided by the organizer are prices agreed by agreement in accordance with the provisions of Act No. 526/1990 Coll., on prices, as amended. Prices do not include VAT. VAT will be charged according to the applicable legislation. 5. Exhibits 5.1. An exhibit is an object (hereinafter referred to as an exhibit) that is bindingly registered and displayed in the space specified by the Organizer. Exhibits can only be those objects which, by their nature, correspond to the focus of the Event and are accepted by the Organizer. For this approval, the Exhibitor must provide the Organizer with a complete "List of Exhibits" with their brief description no later than 4 weeks before the start of the Event. Any exceptions beyond the scope of the Event are granted by the Organizer.
5.2. The exhibitor is entitled to make the subject of his presentation at the Event only an exhibit of which he is the owner or authorized user and which is not an illegal counterfeit of a tangible or intangible nature in violation of intellectual property laws applicable in the Czech Republic. If the contrary is proven, the Organizer is entitled to proceed according to paragraph 10.4 of the OP. The organizer is also not responsible for any damages incurred by the Exhibitor as a result of a violation of this provision on his part.
5.3. The Exhibitor is obliged to immediately notify the Organizer of any changes to the exhibits. An exhibitor who arbitrarily displays an exhibit that does not comply with the OP shall pay a contractual fine of CZK 50,000 for each such display of an exhibit and must remove the non-compliant exhibit immediately, otherwise he will be excluded from participation in the Event. The Exhibitor must secure the exhibits against theft. The arrival and departure of exhibits is governed by the Organizer's instructions. The exhibitor is obliged to deliver all installation material and exhibits to the Event on Friday from 8 a.m. to 9 p.m. and to remove them on Sunday from 5 p.m. to 10 p.m. The exhibitor shall pay a contractual fine of CZK 100,000 for exhibits and installation material not removed after the specified date of the event.
5.4. Acceptance of exhibits and decorations is generally carried out by the Exhibitor. In the event that the Exhibitor or his representative is not present, the exhibit and decorations will be placed on the allocated exhibition area at the risk of the Exhibitor. It is not permissible to take exhibits away during the event.
5.5. Trademarks, designs and official logos (hereinafter referred to as protected design) may be used exclusively by authorized entities (according to the relevant law) in their exhibitions, i.e. also on exhibits, decorations or banners, etc., or by such entities that have the written consent of the authorized entity to their use. 6. Construction and installation of exhibitions, assembly of exhibits 6.1. Installation of the exhibits will take place on Friday, July 12, 2024 from 8 a.m. to 9 p.m., dismantling on Sunday, July 14, 2024 from 5 p.m. to 10 p.m.
6.2. The exhibitor is fully responsible for damages caused during the realization of exhibitions, in particular for compliance with the dates of assembly and disassembly of exhibitions.
6.3. Entrances and entrances to the area during assembly, the course of the event and dismantling - the Exhibitor will receive the ordered number of non-transferable Tickets for staff. If it is necessary to enter the AMD premises by car during the installation or dismantling of the exhibition, the Exhibitor will be sent a security deposit. The deposit will amount to CZK 2,000 and will be payable on the spot in cash before entering the AMD premises. If the vehicle does not return the deposit card by 9 p.m. on Friday in the case of installation of the exhibit or by 10 p.m. on Sunday in the case of dismantling the exhibit, the deposit will be forfeited to the Organizer.
6.4. The exhibitor or the contractor authorized by him is obliged to properly take over the allocated exhibition area from the Organizer or the Staff before starting the installation. After dismantling, the Exhibitor or the contractor authorized by him must remove and transport at his own expense all used material, including carpets, PVC, chipboard, adhesive carpet tapes and adhesive residues, etc. and hand the clean area back to the Organizer or the Staff.
6.5. Safety devices may not be moved or built into. Encroachments on open areas are prohibited.
6.6. The maximum height of exhibitions, including banners, is 3 meters (higher only by agreement).
6.7. The architectural design and operation of the exhibition must not interfere with or limit the surrounding exhibitions. The contour of the allocated area cannot be exceeded even above the level of the ceiling structure.
6.8. Electrical connections can only be ordered from the Organizer.
6.9. The Exhibitor is obliged to restore any damage to the exhibition area and equipment to its original condition at its own expense or to reimburse the costs incurred by the Organizer.
6.10. The exhibitor (or a company authorized by him) may not dismantle the exhibition before the end of the Event.
6.11. The Exhibitor undertakes to hand over the exhibition area to the Organizer in the condition in which he took it over after the end of the Event and is liable for all damages to the object of use, internal equipment and facilities as well as access roads in the AMD premises. The Exhibitor undertakes to pay for the resulting damages immediately. 7. Promotion, advertising and signs 7.1. The exhibitor is entitled to promote his products only in his own exhibition.
7.2. All methods of demonstration on the own exhibition area or outside it are subject to the approval of the organizer, who is entitled to limit or prohibit demonstrations in the event that they cause noise, dust, fumes, shocks that threaten the safety of visitors and exhibitors, or limit or cancel the operation of the Event. At the border of the exhibition area, the noise level must not exceed 70 dB. For musical production at the exhibition, the exhibitor is also obliged to request the approval of the relevant collective copyright administrator (OSA, INTERGRAM) in accordance with Act No. 121/2000 Coll., Copyright Act, as amended. Placing company banners, spreading leaflets, pasting promotional and informational materials outside the exhibition itself is prohibited. The organizer is entitled to prohibit all advertising that does not comply with the above-mentioned paragraphs, or to be removed at the Exhibitor's expense. 8. Additional instructions for exhibitors 8.1. The Exhibitor is responsible and liable for compliance with the provisions of this contract and business conditions by persons participating in the Event together with the Exhibitor, such as its employees, representatives, contractual partners or guests (hereinafter referred to as "Other persons"), who is obliged to inform them of all Other persons participating in the Event.
8.2. Motor sport is dangerous and the Exhibitor takes this into account.
8.3. The organizer is not responsible for securing the belongings of all persons participating in the Event against loss and damage. The Organizer is not liable to the Exhibitor for the loss, destruction or any damage to the exhibit, stand equipment and facilities, goods, packaging and packaging material, items left at the stand, regardless of whether the destruction or other damage occurred before, during or after the Event. The exhibitor will take out individual insurance for this purpose.
8.4. Parking is allowed only in areas reserved by the organizer.
8.5. Participants of the Event, except for visitors, are allowed to bring any food and drinks to the Event exclusively for their own personal use. The provision of food / restaurant / catering services in the Automotodrom Area is completely prohibited and the Exhibitor as well as Other persons are obliged to refrain from such conduct. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay a contractual fine of CZK 150,000 per day to the Organizer for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.
8.6. It is absolutely necessary to follow traffic signs and traffic regulations on road traffic in the entire Automotodrom Area.
8.7. The movement of unauthorized persons and dogs or other animals in the start and finish area, pits and on the race track is strictly prohibited.
8.8. Persons under the age of 15 can only access the Automotodrom Area when accompanied by a person over the age of 18, and this person is fully responsible for their behavior. Children under the age of 15, persons on roller skates, skateboards or bicycles are strictly prohibited from entering the area in front of the pit lane and the start and finish line. The free movement of children under the age of 15 on motorcycles or minibikes is prohibited throughout the AMD Campus. Children under the age of 15 are strictly prohibited from entering the service road along the race track. Children under the age of 18 are strictly prohibited from entering the racing track and may not engage in sports activities.
8.9. Driving under the influence of intoxicating substances (alcohol, drugs) is strictly prohibited throughout the AMD Campus.
8.10. Driving on the race track and service roads is strictly prohibited. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay the Organizer a contractual fine of CZK 50,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.
8.11. The Exhibitor is responsible for all damages incurred by the Organizer or AMD due to damage or destruction of its property by the Exhibitor or a person participating in the Event together with the Exhibitor.
8.12. In connection with the security regime of the AMD premises, the Exhibitor is obliged to provide all Other Persons with appropriate entrances and exits. The Exhibitor and Other persons are obliged to present these documents to the security staff upon arrival at the premises.
8.13. Before 7:00 a.m. and after 9:00 p.m., the vicinity of the AMD Campus must not be burdened with impermissible noise from the operation of motor vehicles or any other source of noise. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay the Organizer a contractual fine of CZK 100,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.
8.14. Service communication is a particularly dangerous area and only persons approved by the Organizer have access to it. Traffic is one-way in the direction of travel along the race track. Exceptions are vehicles with right-of-way – ambulances, rescue system. All such persons will be wearing a reflective warning vest and will be instructed by the Organizer or Staff about the possible risks of movement on service roads and must sign such instruction and consent to this risk.
8.15. Max. speed in the area (except the race track) is 20 km/h.
8.16. Exhibitors and other persons have access to the AMD Area on Friday 12/07/2024 from 8:00 a.m. to 9:00 p.m., on Saturday 13/07/2024 from 7:00 a.m. to 9:00 p.m. and on Sunday 14/07/2024 from 7:00 a.m. Exhibitors and other persons are required to leave the AMD Premises no later than Sunday 14 July 2024 by 10 p.m. Later departure is possible only with the prior written permission of the Organiser.
8.17. The equipment used must be used only for the agreed purposes. In the pits and in the security zone behind the pits (up to the white line) it is forbidden to spend the night, smoke and handle open fire - grilling and operating catering services. Compliance with this regulation will be checked during the Event. If the Exhibitor or other persons violate this regulation, the Exhibitor shall pay the Organizer a contractual fine of CZK 50,000 for each detected case of violation, immediately after receiving the first request for payment from the Organizer. The Exhibitor and Other persons are obliged to use electric hand tools that meet the ČSN EN 50699 standard and electrical appliances that meet the ČSN EN 50678 standard.
8.18. It is prohibited to use electric or gas heating equipment in the entire AMD Area, including the boxes, without the prior written consent of the Organizer. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay the Organizer a contractual fine of CZK 20,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.
8.19. Handling pyrotechnics and fire is strictly prohibited in the AMD Campus.
8.20. Drilling into the asphalt (building tents anchored to the ground, etc.) is strictly prohibited in all areas of the AMD Campus. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay the Organizer a contractual fine of CZK 150,000 for each such breach of contractual obligation, immediately after receiving the first request for payment from the Organizer.
8.21. The exhibitor and other persons are obliged to take care of the protection of the environment and are obliged to put garbage in containers, to observe traffic signs in the area and a speed of 20 km/h. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay the Organizer a contractual fine of CZK 20,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer. Furthermore, Exhibitors are obliged to use water sparingly. It is strictly forbidden to turn on taps for no reason, to cool drinks under running water and to fill swimming pools. If the Exhibitor or other persons violate this regulation, the Exhibitor shall pay the Organizer a contractual fine of CZK 50,000 for each detected case of violation, immediately after receiving the first request for payment from the Organizer.
8.22. The free running of animals, especially dogs, is prohibited in the entire area of the AMD Area, and if the Exhibitor or other persons violate this obligation, the Exhibitor shall pay a contractual fine of CZK 10,000 to the Organizer for each such violation of the contractual obligation, immediately after receiving the first notice to be paid by the Organizer. Every owner is required to keep their dog on a leash and put a muzzle on it.
8.23. It is prohibited to use unmanned aerial vehicles (UAVs – drones) in the entire AMD Area, including the boxes, without the prior written consent of the Organizer. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay the Organizer a contractual fine of CZK 100,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.
8.24. Charging of electric vehicles is prohibited in the entire AMD Area, including the pits, without the prior written consent of the Organizer. If the Exhibitor or other persons violate this obligation, the Exhibitor shall pay the Organizer a contractual fine of CZK 100,000 for each such breach of contractual obligation, immediately after receiving the first payment request from the Organizer.
8.25. In case of violation of these terms and conditions, if these terms and conditions do not provide for another sanction, or damage to equipment in the AMD Area, the Organizer is entitled to claim a contractual fine of CZK 50,000 from the Exhibitor for each such breach of contractual obligation, immediately after receiving the first call to be paid by the Organizer.
8.26. The price of the Exhibitor includes first medical aid in case of injury to the Exhibitor or other persons. This medical treatment is carried out at the health center in the AMD Campus. Medical examination and treatment will be provided free of charge to the extent not covered by points 8.25. and 8.26. or more complex than the procedures and treatments listed there.
8.27. Treatment of more serious injuries, in which it is necessary to use an X-ray examination and definitive treatment by applying a plaster cast or surgical treatment with a suture (sewing), will be paid for by the injured person in cash or by payment card on the basis of a document issued according to the list of medical procedures, which is valid in all medical facilities in the territory of the Czech Republic. The value of 1 point is contractually set at CZK 15 in the Exhibitor's non-state medical facility.
8.28. The use of special (extra-standard) dressing material or orthopedic aids, to which the injured person gives his consent, will be charged according to the valid List of medical equipment or according to the calculated price and paid to the injured person in cash or by payment card based on the issued document.
8.29. The transport of the injured (by ambulance or helicopter) to the hospital in Brno, as indicated by the attending physician, will be arranged by the attending physician. Reimbursement for this transportation service is paid to the insured carrier.
8.30. The organizer is authorized to make photographic and audiovisual records of the event. The Organizer is entitled to transfer these records to another person. The Exhibitor and Other Persons are obliged to respect the existing advertisements of third parties in the AMD Area and the performance associated with them, and these advertisements must not overlap or make it difficult to see them in any way, and if the Exhibitor or Other Persons violate this obligation, they will be asked by the Organizer to immediately remove this fact. In the event that the Exhibitor or Other persons do not obey the immediate call, the Exhibitor shall pay the Organizer a contractual fine of CZK 500,000 for each such breach of contractual obligation, immediately after receiving the first call for payment from the Organizer.
8.31. Activities in the Motor Speedway Area, such as installing VIP-tents, banners, advertising flags, etc., are prohibited without prior written agreement with the Organizer, and if the Exhibitor or other persons violate this obligation, the Exhibitor will pay the Organizer a contractual fine of CZK 250,000 per any such case of breach of contractual obligation, immediately after receiving the first call for payment from the Organizer.
8.32. The Exhibitor and Other persons undertake to comply with all extraordinary measures and recommendations of the Government of the Czech Republic, the Ministry of Health of the Czech Republic, the regional hygiene station or other state administration bodies related in particular to the spread of the COVID-19 infection.
8.33. By submitting the registration form, the Exhibitor agrees to these OPs.
8.34. The Exhibitor agrees to send information related to the Event and services or E-tickets and business communications from the Organizer to the Exhibitor's email address.
8.35. The exhibitor agrees to the storage of so-called cookies on his computer. In the event that it is possible to register on the website and fulfill the Organizer's obligations from the purchase contract without so-called cookies being stored on the Exhibitor's computer, the Exhibitor may revoke the consent in accordance with the previous sentence at any time. 9. Force majeure 9.1. The contracting parties are released from liability for partial or complete non-fulfillment of contractual obligations under this contract if this non-fulfillment is due to force majeure. If the circumstances of force majeure do not last longer than three days, the contracting parties are obliged to continue to fulfill their obligations under the contract, while the performance deadlines are extended by the duration of the force majeure. The contractual party that invokes force majeure is obliged to notify the other party immediately and in writing, but no later than five (5) days from the occurrence of the force majeure circumstances. In the same way, it notifies the other party of the termination of force majeure circumstances. At the request of the contractual party that has been notified of the circumstances of force majeure, the other party is obliged to submit credible evidence of this fact. If one contracting party fails to notify the other party of the occurrence of a case of force majeure, the party that violated its notification obligation loses the right to refer to the case of force majeure. Cases of force majeure extend delivery times by analogy. If the circumstances of force majeure last longer than three days, then the contractual party against whom the force majeure acts is entitled to withdraw from this contract. As cases of force majeure apply: war, mobilization, natural disasters and other disasters that the contracting party could not foresee or overcome without incurring disproportionate costs. 10. Final Provisions 10.1. In the event that the organizer, due to circumstances not attributable to him, cannot start the Event, ensure that it takes place for the entire duration of it, or part of it, he will immediately notify the exhibitor. All obligations incurred by the organizer from the concluded contract on the exhibitor's participation shall cease. In this case, the exhibitor is not entitled to compensation for any damages incurred.
10.2. If, on the basis of an instruction of the organizer or the relevant state authorities issued to avert imminent damage, the AMD Site is cleared and if damage to the Exhibitor's property occurs as a result, i.e. damage, destruction or theft of this property, this is a state of extreme emergency and The organizer is not responsible for damage caused in this way.
10.3. Any agreements on contractual fines contained in these OPs are negotiated separately and independently of the Organizer's right to demand compensation for damages incurred in connection with the breach of a contractual obligation, the fulfillment of which is ensured by the contractual fine.
10.4. The Exhibitor may file a complaint for the services provided by the Organizer to the responsible employee without undue delay, in writing. Otherwise, his right expires.
10.5. Unless otherwise stipulated, the organizer is entitled to exclude the Exhibitor from further participation in the Event in case of violation of any of the provisions of these OPs. In such a case, the Exhibitor shall not be entitled to compensation for any damages or to the refund of the price paid in the meantime. In Brno on 8 January 2024
